The "Grand Furniture Store Makeover" Promotion (the "Promotion") begins
November 4, 2009 and ends on November 28, 2009 (the Promotion Period) at
midnight. The Promotion is sponsored by Grand Furniture Corporate with
office located at 1305 Baker Road, Virginia Beach Virginia. You must
accept these rules, terms and conditions to be eligible to participate in
the Promotion, and by participating you are deemed to have accepted all
such rules, terms and conditions ("Official Rules").
- ELIGIBILITY. The Promotion is open only to households in Hampton
Roads, Virginia. Employees, shareholders, officers, directors, agents,
and representatives of the Sponsor and its immediate families members
and those living in their household, and each person or entity connected
with the production, administration or judging of the Promotion, and
each parent company, affiliate, subsidiary, agent and representative of
any aforementioned entity are not eligible to participate in the
Promotion. THE PROMOTION IS VOID WHERE PROHIBITED OR RESTRICTED.
- HOW TO PARTICIPATE. Subject to eligibility requirements in these
Official Rules, The Promotion participants must access the link to the
Sponsor's website located at www.grandfurniture.com to complete the online
entry form in its entirety.
- DETERMINATION AND NOTIFICATION OF WINNERS. All validly submitted
entries will be gathered. The winning Promotion entry will be based on
the random computerized drawing based on such criteria as the judges may
choose in their discretion, after considering all validly submitted
entries. The DECISION OF THE JUDGES IS FINAL. The winner will be
contacted via e-mail on or about December 2, 2009. If the winner does
not claim the Prize in a timely manner, the Grand Furniture reserves the
right to perform a new random drawing on order to select the winner.
- PRIZE. One (1) prizewinner will receive 82" High Definition TV from
Grand Furniture with an aggregate retail value of $4599. Winner cannot
assign or transfer prize to another person. No prize substitution or
cash awards will be made. If the prize cannot be awarded due to
circumstances beyond the control of the Sponsor, a substitute prize may
be awarded at the discretion of the Sponsor. Grand Furniture will
contact the winner to make all necessary arrangements associated with
the delivery and/or picking-up of the furniture. In addition, the prize
being awarded may constitute income under federal, state and local tax
laws and winner shall be solely responsible for payment of any and all
taxes which may be due with respect to the acceptance of the prize.
- CONDITIONS. The Promotion is subject to these Official Rules. By
completing the application for and participating in the Promotion,
participants: (i) agree to be bound by these complete Official Rules and
the decisions of the Sponsor which shall be final and binding; (ii)
hereby waive any right to claim ambiguity in the Promotion or these
Official Rules; and (iii) hereby release, discharge, indemnify, and hold
harmless the Sponsor (including the parent, subsidiary and affiliated
entities thereof), together with the respective directors, stockholders,
employees, officers, licensees, licensors, affiliated entities and
agents of each such entity associated with the production, judging, or
administration of the Promotion (collectively, the "Releasees"), from
any and all liability, loss or damage arising from or in connection with
participation in the Promotion and/or use or misuse of prize or any
prize-related activities. The Sponsor reserves the right to use the
Promotion for publicity purposes in any media, and participation in the
Promotion and/or acceptance of any prize constitutes permission of the
sponsor and its perspective designees, to use the names, photographs,
video images, likenesses, and hometown names and/or prize information of
the participants and winner as part of that publicity, without any
compensation or prior review unless prohibited by law. In Addition, the
winner shall be required to complete and return to the Sponsor its form
of publicity release and other documentation required by the Sponsor to
confirm the winner's eligibility to participate in the Promotion and
release the Sponsors from liability related to the Promotion and related
promotional activities. Winner who receives the prize may receive a
federal 1099 tax form showing the value of the prize awarded to the
winner; however, taxes on the prize, if any, are the sole responsibility
of the winner. The Promotion is void where prohibited or restricted by
law, and is subject to applicable federal, state, and local laws.
Sponsors reserve the right to disqualify any participant it finds to be
tampering with the entry process or the operation of the Promotion or
violating these Official Rules. The Releasees shall not be responsible
for the and shall not be liable to any person for: (i) late, lost,
delayed, stolen, misdirected, incomplete, unreadable, inaccurate,
garbled or unintelligible communication in connection with the Promotion
, regardless of the method of transmission; (ii) telephone system,
telephone or computer hardware, software or other technical or computer
malfunctions, lost connections, disconnections, delays or transmission
errors, including any inability to participate in the Promotion at any
given time during the Promotion Period; (iii) data corruption, theft,
destruction, unauthorized access to or alteration of entry or other
materials; (iv) any injuries, losses or damages of any kind caused by
the prizes or resulting from acceptance, possession or use of a prize,
or from participation in the Promotion; or (v) any printing,
typographical, administrative or technological errors in any material
associated with the Promotion. Sponsor disclaims and shall not be
responsible for any liability for damage to any computer system
resulting from participating in, or accessing or downloading information
in connection with, this Promotion (including any damages caused by a
virus, bug, computer problem, unauthorized intervention or other causes
beyond the Sponsor's control), and Sponsor reserves the right, in their
sole discretion, to immediately and without prior notice cancel, modify
or suspend the Promotion should a virus, bug, computer problem,
unauthorized intervention or other cause beyond the Sponsor's control
corrupt the administration, security or proper play of the Promotion.
The Promotion will be governed by the internal laws of the Commonwealth
of Virginia. Any and all legal actions or claims arising in connection
with the Promotion must be brought in a court of competent jurisdiction
within the United States.
